Written by Mary Anne Franks, a professor at the University of Miami School of Law, who, last fall, penned a proposal for a “redo” of the First and Second Amendments in a Boston Globe op-ed:
“Speech and guns: two of the most contentious issues in America today, with controversies fueled not only by personal passions and identity politics but by competing interpretations of the Constitution. Perhaps more than any other parts of the Constitution, the First and Second Amendments inspire religious-like fervor in many Americans, with accordingly irrational results.As legal texts go, neither of the two amendments is a model of clarity or precision. More important, both are deeply flawed in their respective conceptualizations of some of the most important rights of a democratic society: the freedom of expression and religion and the right of self-defense. These two amendments are highly susceptible to being read in isolation from the Constitution as a whole and from its commitments to equality and the collective good. The First and Second Amendments tend to be interpreted in aggressively individualistic ways that ignore the reality of conflict among competing rights. This in turn allows the most powerful members of society to reap the benefits of these constitutional rights at the expense of vulnerable groups. Both amendments would be improved by explicitly situating individual rights within the framework of “domestic tranquility” and the “general welfare” set out in the Constitution’s preamble…”

Franks’ suggestions are designed to subvert the individualistic nature of America and its Constitution, and she poorly argues that we should make our natural rights subject to “the common good.” In case you don’t understand why this is a bad idea, let me ask you this: Who decides what the “common good” is? Would the “common good” depend on who is in power at the time? Would it change every 2-4 years? Is there a magical definition? Of course not. Who deserves such power over another human? No one, that’s who.
Freedom means being free from someone else’s notion of what the “common good” is, because it is as unknowable as the billions and billions of humans on Earth. These illogical and irrational “thinkers” are again coming with their mumbo-jumbo nonsense to try to usher in an “equitable” (communist) future.
Fight this assault on our individual rights (our freedom) with every fibre of your uncommon being! Please and thank you.

For those who know me, I don’t have a particular skin in the game as to whether it is conservative or progressive voices (or anyone in between) being silenced… I have an issue with censorship per se. True story: About a year after I was arrested & charged with felony wiretapping carrying a 7-year sentence for filming police officers during a late night traffic stop, and after my 4/20/10 arraignment where all charges against me were dropped, my camera had STILL not been returned more than a year later, so we went to the Weare PD to protest. The coppers shut down the PD early rather than face us.About 15-20 Free Staters gathered on the front lawn of the police station and held a 420 rally at 4:20p. Someone had brought a portable fire pit, and made a safe fire, BBQing some 
. Around 5pm, a black truck peeled into the parking lot and a man jumped out with a stack of pizza boxes.All ham and bacon related.On the top box was written: “A porky special from your friends at the Weare PD.”Now say what you will about their arresting, lying, cheating, stealing, threatening, Thin Blue selves– all obviously piggish sentiments–you have to admit, it was a solid move.Everyone else ate the pizza. I did not.

Wednesday was eventful! Morning: working on the The Carla Gericke Show (catch the latest episode HERE). Early afternoon, walked our future property at Bardo with Emily Smith (you don’t realize how deep in the forest you are till you see how small we are in the pics).
Early evening listening to heroic investigative reporter and now Regime-persecuted James O’Keefe speak at Dartmouth. I was ready for a Free Speech rumble, but everyone was awfully polite. Thanks for all you do, James!
James and I have met over the years, we even had drinks once at The Copper Door back in 2013 or 2014 when I was still drinking. We caught up for a quick “hello” in South Dakota at Freedom Fest too. Yesterday, I had him sign a copy of Muckracker and gave him a copy of my book, The Ecstatic Pessimist with a Free State of NH passport strategically placed to open to my essay about Orwell that I delivered at the launch of Ben Swann’s Truth in Media in 2013.

UPDATE 2:
On Friday, Twitter introduced a poison pill rather than accept generous offer. The Twitter board has a fiduciary duty to consider all offers in GOOD FAITH.
By rejecting an offer at 54% PREMIUM, they are screwing their s/holders, and opening themselves to a massive shareholder lawsuit. All this now obviously to continue to suppress free speech and rig elections in favor of their favored candidates.
FYI: Invoking the “poison pill” means if any person or group acquires 15%+ of Twitter’s outstanding common stock without board approval, other s/holders can buy additional shares at a discount <–to fend off a “hostile takeover”. Yesterday, they diluted the stock to reduce Elon’s stake.
The original offer represented a 54% premium, which has now been reduced to 18%. The question investors should ask themselves is why they would continue to hold Twitter stock now that the Board has shown it will BREAK THE LAW and choose SJW/Wokeness over its fiscal duties.
Then Twitter’s Board hires Goldman Sachs–you know, Too Big To Fail guys–to advise them on the offer. They say it’s not a “fair offer in good faith,” BUT, the premium offer of $54.20 is ABOVE their own buy/sell recommendation of $30. This was Elon’s response.

Update 4/21/22: Looks like Elon has borrowed enough money to take an offer of $46.5B directly to the shareholders, thus circumventing the poison pill, so currently, in the Saga of Twitter’s Free Speech Suicide Squad: “Tesla CEO Elon Musk said in a filing Thursday he has secured $46.5 billion in financing to buy Twitter — mostly with borrowed money.”
